Welcome to Smartass Support Cards, a service owned and operated by Gnandt & Associates Inc., a California corporation. By accessing or using our website or services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

1. Services Provided

Smartass Support Cards offers users the ability to create, customize, and send digital greeting cards for occasions of sympathy, loss, and support. All cards are purchased individually; we do not offer subscription plans.

2. Eligibility

To use our services, you must:

  • Be at least 18 years old or have the consent of a parent or guardian.

  • Agree to use the services only for lawful purposes. 

3. Purchasing and Payment

  • Each card must be purchased individually.

  • Prices are displayed at checkout and are subject to change without notice.

  • Payments are processed securely through third-party providers. Smartass Support Cards does not store your payment details. 

4. User Content

You may submit messages, photos, and other content to customize your card. By submitting content, you agree to the following:

  • You have the rights to use and share the content.

  • Your content will not violate any laws, infringe on the rights of others, or contain offensive, defamatory, or inappropriate material.

  • We reserve the right to review and remove content that violates these Terms or is deemed inappropriate.

5. Privacy

We respect your privacy and handle your information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy. 

6. Delivery and Access

  • Completed cards are sent via email to the recipient as a digital link.

  • The link to the cards will not expire, but the personalized note will expire 90 days from the date of delivery unless otherwise stated.

  • A downloadable version of the card will not be available after delivery. 

7. Refunds and Cancellations

Due to the personalized nature of our services, all sales are final. If you experience an issue with your purchase, please contact us at support@smartass.cards, and we will work to resolve the matter.

8. Prohibited Activities

When using Smartass Support Cards, you agree not to:

  • Violate any applicable laws or regulations.

  • Submit false, misleading, or offensive content.

  • Interfere with or disrupt the operation of the service or its servers.

9. Intellectual Property

All materials, designs, and content provided by Smartass Support Cards are the property of Gnandt & Associates Inc. and are protected by U.S. and international trademark and copyright laws. You may not reproduce, sell, distribute, or use our content without explicit permission. 

10. Limitation of Liability

To the fullest extent permitted by law, Smartass Support Cards and Gnandt & Associates Inc. will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our services.

11. Governing Law

These Terms are governed by the laws of the United States and the State of California. Any legal action or proceeding will be resolved exclusively in the courts located in California.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting. Your continued use of the service constitutes acceptance of the updated Terms.
